# Terms of Use

## 1. Introduction

By downloading, installing, or using the Endure Path application (“App”) or accessing endurepath.com, you confirm that you have read, understood, and agree to be bound by these Terms of Use / End User License Agreement (“Agreement”).

## 2. Scope of License

This App is licensed, not sold, to you by Endure Path for use strictly under the terms of this Agreement. Subject to your compliance, Endure Path grants you a limited, non-exclusive, non-transferable, non-sublicensable license to:

- Install and use the App solely on Apple-branded products that you own or control, and
- Use it as permitted by the Usage Rules set forth in the App Store Terms of Service.

Any use of the App not expressly permitted by this Agreement is prohibited.

## 3. Acknowledgement

You acknowledge that this Agreement is between you and Endure Path only, and not with Apple. Apple is not responsible for the App or its content. Apple has no obligation whatsoever to furnish any maintenance or support services for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) you paid for the App. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Endure Path’s sole responsibility. ## 4. Agreement Effective Date and Duration

This Agreement takes effect on the date you first download, install, or use the App and remains in force until terminated by you or Endure Path. If you breach any term, your license to use the App will automatically terminate without notice, and you must delete all copies of the App.

## 5. Subscription Terms

- Payment will be charged to the payment method linked to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel your subscription at any time by going to your App Store account settings after purchase.
- No refunds are provided for unused portions of a subscription term.

## 6. Product Usage and Updates

By using the App, you agree to receive important product updates via the email linked to your account. You can opt out at any time by using the “Unsubscribe” link in any such email.

## 7. Disclaimer of Warranties

You agree that your use of the App is at your sole risk. To the maximum extent permitted by law:

- The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind.
- Endure Path does not warrant that the App will meet your requirements or operate uninterrupted or error-free.

## 8. Limitation of Liability

To the maximum extent permitted by law:

- Endure Path shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or other intangibles, arising from your use of or inability to use the App.
- In no event shall Endure Path’s total liability exceed the amount you paid for your subscription or the App, if any.

## 9. User Responsibilities

You are solely responsible for any content you create, upload, or share through the App and for complying with all applicable laws.

## 10. Third-Party Terms

The App may use or include third-party services. You agree to comply with applicable third-party terms and acknowledge that Endure Path is not responsible for such services.

## 11. Governing Law

This Agreement is governed by the laws of Ukraine, excluding its conflict of laws rules. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Ukraine.

## 12. Severability

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
